CONSTITUTION of
SOUTHERN COMMUNITY COUNCIL (SHEFFIELD)


ARTICLE 1: NAME

The name of the organisation is “The Southern Community Council - Sheffield”, referred to hereinafter as The “Council”. The “Council” is an independent organisation and has no affiliation or objects of either a party political or a religious denominational nature.

المادة 1:  الأسم

يسمى هذا الكيان  "مجلس الجالية الجنوبية – شفيلد" وسيشار اليه في هذه الثويقة  با "المجلس" – ويعتبر المجلس كيان مستقل ليس لها اي انتماءات او أهداف ذات طابع سياسي حزبي او ديني.


ARTICLE 2: ADMINSTRATION

a)      Subject to the matters set out below the “Council” and its property shall be administered and managed in accordance with this Constitution by the members of the Management Committee as constituted in accordance with Articles 6 herein.

b)      The Head Office of the “Council” shall be based in the city of Sheffield where the Management Committee shall be based.


المادة الثانية: الأدارة

1- وفقاً لما هو وارد في مواد هذا الدستور يتم ادارة وتسيير امور "المجلس" وممتلكاته من قبل الهيئة الأدارية المشكلة بموجب المادة 6 من هذا الدستور.

2 – يقع المكتب الرئيسي للمجلس في مدينة شفيلد وهو المقر الرئيسي للهيئة الأدارية للمجلس.


ARTICLE 3: OBJECTS

The objects of the “Council” are to:

1.       Support members of the South Yemeni Community in the United Kingdom to realise their maximum potential in all aspects of life, including education, employment and the relief of poverty.

2.       Promote greater integration of the South Yemeni Community into British society and encourage its members to exercise their rights and fulfil their duties as British citizens.

3.       Promote the culture and history of South Yemen and organise events to create awareness of the same.

4.       Oppose all forms of extremism and work within the South Yemeni Community in the United Kingdom to combat all forms of its manifestations.

5.       Promote awareness of the continuing struggle of the people of South Yemen against the occupying forces of North Yemen.

6.       Expose the violations of human rights and other crimes being committed against the people of South Yemen by the occupying Northern forces and its affiliates.

7.       Initiate and maintain contact with the British political establishments including MPs, MEPs, local Counsellors as well as relevant government departments to update them on the situation in South Yemen and to seek their support for the right of the people of South Yemen in their struggle for self-determination.

8.       Initiate and maintain contact with human rights organisations and other relevant non-governmental organisations to raise awareness of the human rights violations being perpetrated against the people of South Yemen on the hands of the Northern occupying forces and their affiliates.

9.       Liaise with organisations with similar objects to co-ordinate joint strategies and actions to achieve such objectives.

المادة الثالثة: الأهداف

يعمل المجلس على تحقيق الأهداف التالية:

1 - حث أبناء الجالية الجنوبية في الممكلة المتحدة ودعمهم على تحقيق طموحاتهم وتطلعاتهم بما تسمح لهم امكانياتهم في جميع جوانب الحياة بما في ذلك التعليم والعمل والتغلب على الفقر.

2- حث ابناء الجالية الجنوبية في المملكة المتحدة على الأنخراط البناء في المجتمع البريطاني والدفع بهم الى ممارسة حقوقهم والوفاء بواجباتهم كمواطنين بريطانيين.

3- العمل على رفع مستو الوعي عن تاريخ وثقافة الجنوب وتنظيم الفعاليات والأنشطة لتحقيق ذلك.

4- نبذ كل اشكال التطرف والكراهية والعمل بين اوساط الجالية الجنوبية في المملكة المتحدة  لمكافحة اي شكل من اشكالها.

5 – العمل على رفع مستوى الوعي بين اوساط المجتمع البريطاني عن نضال الشعب الجنوبي السلمي في رفض الأحتلال الشمالي للجنوب.

6 – كشف وأبراز انتهاكات حقوق الأنسان وغيرها من الجرايم التي ترتكب ضد الشعب الجنوبي من قبل قوات الأحتلال الشمالي وحلفائه.

7 -  التواصل مع السلطات الرسمية البريطانية بما في ذلك أعضاء البرلمان البريطاني وأعضاء البرلمان الأوروبي وأعضاء المجالس المحلية والدوائر الحكومية ذات الصلة لأطلاعهم على الوضع في الجنوب وطلب الدعم منهم للشعب الجنوبي في نضاله ضد الأحتلال ودعم حقه في تقرير المصير.

8 – التواصل مع منظمات حقوق الأنسان وغيرها من المنظمات غير الحكومية لأطلاعها على انتهاكات حقوق الأنسان التي ترتكب ضد شعب الجنوب من قبل قوات الأحتلال الشمالي وحلفائه.

9 – التواصل مع المنظمات التي تحمل نفس الأهداف والتنسيق معها لخلق استراتجية موحدة لتحقيق الأهداف المشتركة.


ARTICLE 4: POWERS

In order to achieve its aim the “Council” may:

a) Raise money
b) Open bank accounts
c) Acquire and run buildings
d) Take out insurance
e) Employ staff
f) Organise courses and events
g) Work with similar Organisations and exchange information and advice with them
h) Do anything that is lawful which will help it to fulfil its aim.

 المادة الرابعة: الصلاحيات

من اجل تحقيق أهدافه, يحق للمجلس ان:

أ- طلب الدعم المادي جمع المال
ب-  فتح حساب بنكي
ج- امتلاك وأيجار المباني والمقرات
د- طلب التأمين
ه- توضيف عمال
و- تنظيم الدورات والنشاطات
ز- التنسيق مع منظمات مشابهه لتبادل المعلومات والتشاور معها
ح – اتخاذ اي خطوات, وفقاً للقانون, لتحقيق أهدافه

ARTICLE 5: MEMBERSHIP

a)      Membership of the “Council” shall consist of the populations of the various regions of South Yemen which make up the South Yemeni Community in Sheffield. The Membership’s responsibilities shall be to:

1-      Elect the Management Committee
2-      Approve the Council’s Constitution and any amendments to be made to it
3-      Discuss and approve the Annual Reports
4-      Call a Special General Meeting.


المادة الخامسة: العضوية

أ – تتكون الجمعية العمومية للمجلس من تجمعات مناطق الجنوب المختلفة والتي تشكل الجالية الجنوبية في مدينة شفيلد.

وتتحمل الجمعية العمومية المسؤليات التالية:

1- أنتخاب الهيئة الأدارية للمجلس
2- أقرار دستور المجلس وأي تعديلات تجرى لها
3- مناقشة وأقرار التقارير السنوية
4- ألدعوة الى أجتماع عام أستثنائي بقرار ثلث الأعضاء

ARTICLE 6: MANAGEMENT COMMITTEE

a)      The Management Committee shall consist of at least 7 members and no more than 15 members.

b)      Each Member of the Council shall nominate its candidate(s) to the Management Committee by consensus.

c)       Where it is not possible to nominate a candidate by consensus, the Member Region shall resort to holding an election amongst its membership to choose the candidate(s).

d)      The number of Management Committee members assigned to each Member Region shall be proportional to the size of its numbers within the South Yemeni Community in the Sheffield.

e)      Guidance on the proportion of members to be assigned to each Member Region shall be set at the first AGM and reviewed at every subsequent AGM to take account for any demographic changes which may occur between AGMs.

e) The Management Committee shall by consensus if possible and by election if necessary, appoint a Chairman, a Treasurer and a Secretary, in addition to any other post the Management Committee deems necessary.

f) The Management Committee may set up Specialist Committees in order to perform any tasks necessary to achieving the objects of the “Council”

g) The Management Committee shall meet at least once per month.

h) At least 7 Management Committee members must be present for a Management Committee meeting to take place.

i) Voting at Management Committee meetings shall be by a show of hands. If there is a tied vote then the Chairperson shall have a second vote.

j) The Management Committee shall by a unanimous decision have the power to remove any member of the Committee for good and proper reason.

k) Any Management Committee Member removed shall be replaced by another Member to be nominated by the same Member Region which the removed person represented.

l) The duties of the Chairperson, the Treasurer and the Secretary and any other role in the Management Committee shall be drawn up and agreed by the Management Committee at its first meeting.



المادة السادسة: الهيئة الأدارية

ا – تكون الهيئة الهيئة الأدارية من ما لا يقل عن 7 أعضاء ولا يزيد عن 15 عضواً.

ب- يقوم كل تجمع بأختيار عضوه او اعضائة المحدد عددهم الى الهيئة الأدارية بالتوافق.

ج - في حالة فشل التجمع على اختيار الأعضاء بالتوافق يتم حينها اللجوء الى الأنتخابات لتحديد الأعضاء المرشحين للهيئة الأدارية.

د- يتم تحديد عدد اعضاء الهيئة الأدارية لكل تجمع وفقاً لنسبة كثافة أعضاء ذلك التجمع في مدينة شفيلد.

ه- يلحق الى جانب هذا الدستور لوائح تحدد التجمعات ونسبة أعضاء الهيئة الأدارية لكل تجمع ويقر في الأجتماع العام الأول للمجلس وتعاد مراجعته في كل أجتماع سنوي لمراعاة اي متغيرات ديمغرافية تستدعي التعديل فيها.  

و- تختار الهيئة الأدارية بالتوافق اذا امكن او بتصويت الأغلبية من اعضاءها, رئيس ومسؤول مالي وسكرتير للهيئة اضافةً الى اي مسؤولية اخرى يراها أعضاء الهيئة الأدارية ضرورية.

ز- يحق للهيئة الأدارية تشكيل لجان مختصة للقيام بمهام معينة بأتجاه تحقيق أهداف المجلس.

ك- تجتمع الهيئة الأدارية للمجلس شهرياً على الأقل.

ل- يعتبر نصاب أجتماعات الهيئة الأدارية 7 أعضاء ولا تعتبر نتائج اي اجتماع ملزمة الا بأكتمال النصاب.

م- يتم التصويت على قرارات الهيئة الأدارية برفع الأيادي وفي حالة التساوي في الأصوات يعتبر صوت الرئيس صوتين.

ن- يحق للهيئة الأدارية بألأجماع فصل اي عضو لأسباب معقولة ومقنعة.

س- يتم أستبدال العضو المفصول بعضو اخر من نفس التجمع الذي كان يمثلة العضو المفصول.

ع- تحدد مهام الرئيس والمسؤول المالي والسكريتير اضافةً الى اي مهام اخرى ويتم اقرارها في اول اجتماع للهيئة الأدارية.


ARTICLE 7: FINANCE

a) All monies received by or on behalf of the “Council” shall be applied to further the aim of the “Council” and for no other purpose.

b) Any bank accounts opened for the “Council” shall be in the name of the “Council”.

c) Any cheques issued shall be signed by the Treasurer and one other nominated member of the Management Committee.

d) The “Council” shall ensure that its accounts are audited or independently examined every year.

e) The “Council” may pay reasonable out of pocket expenses including travel, childcare and meal costs to members or Management Committee members.


ARTICLE 8: ANNUAL GENERAL MEETING

a)      The “Council” shall hold an Annual General Meeting (AGM) in the month of November.

b)      All members shall be given at least 21 days notice of the AGM.

c) The business of the AGM shall include:

-          receiving a report from the Chairperson on the Council’s activities over the year
-          receiving a report from the Treasurer on the finances of the “Council”
-          electing a new Management Committee and
-          Considering any other matter as may be decided.

d) At least 10% of members must be present for the Annual General Meeting and any other General Meeting to take place

e) A Special General Meeting may be called by the Management Committee or 33% of members to discuss any urgent matters. The Secretary shall give all members fourteen days notice of any Special General Meeting together with notice of the business to be discussed.

f) Any changes to this Constitution must be agreed by at least two-thirds of those members present and voting at any General Meeting.

ARTICLE 9: DISSOLUTION

The “Council” may be wound up at any time if agreed by two-thirds of those members present and voting at any General Meeting. In the event of winding up any assets remaining after all debts have been paid shall be given to other Organisations with a similar aim.

ARTICLE 10: ADOPTION OF THE CONSTITUTION

Until the first AGM takes place the persons whose names, addresses and signatures appear at the bottom of this document shall act as the Management Committee referred to in this constitution.
